The European Commission provides an online dispute resolution (OS) platform available at https://ec.europa.eu/consumers/odr. We are not obligated and unwilling to participate in a dispute settlement procedure before a consumer arbitration board.

Conditions

    1. Conclusion of the contract

With your order, you submit a binding offer to Peter Hundert Photography, the owner, to conclude a contract with you. By sending an order confirmation by e-mail to you or by the delivery of the ordered goods, we can accept this offer. First, you will receive a confirmation of receipt of your order by e-mail to the e-mail address you have provided (order confirmation). However, a purchase contract only comes into effect with the dispatch of our order confirmation by e-mail to you or with the delivery of the ordered goods.

 

When ordering via our online shop, the order process comprises a total of 4 steps. In the first step you select the desired goods. In the second step you enter your customer data including billing address and, if necessary, different delivery address. In the third step you choose how you want to pay. In the last step, you have the opportunity to review all information (such as name, address, payment method, ordered items) again and correct if necessary, before you submit your order by clicking on ‘buy now’.

 

    1. Storage of the contract text

We save the contract text of your order. You can print it before sending your order by printing the last step of the order. We will also send you an order confirmation with all order details and our terms and conditions to the e-mail address you provided.

 

    1. Retention of title

The delivered goods remain our property until complete payment of all claims.

 

    1. Prices, shipping costs, return costs upon revocation

All prices are final, they include VAT. Plus the following shipping costs:

 

– Free shipping for shipping to Germany.

– When shipping to countries of the European Union Euro 8.00 net.

– For worldwide shipping Euro 26, – net.

Should you make use of an existing right of revocation, you have to bear the regular costs of the return if the delivered goods correspond to those ordered and if the price of the goods to be returned does not exceed 40 EUR or if you order the goods of a higher price but, until the date of withdrawal have not yet made a contractually agreed partial payment. Otherwise, the return is free for you.

 

    1. Terms of delivery

Unless otherwise stated in the offer, we will dispatch the goods within 2 working days after receipt of payment.

 

  1. Terms of paymentThe payment is made either in advance by advance bank transfer, by credit card – by the payment service provider STRIPE, or by PAYPAL. We reserve the right to exclude individual payment methods. If you choose the payment method “advance” we will provide the bank details in the order confirmation. The invoice amount has to be transferred to our account within 10 days. You can only exercise a right of retention if the claims result from the same contractual relationship.

     

  2. Warranty
  3. The warranty is governed by the statutory provisions. As far as used goods are the subject of the purchase contract and the buyer is not a consumer, the warranty is excluded. If the customer is a consumer, the warranty period for the purchase of used items is one year.
  4. Applicable law
  5. It is exclusively German law. This choice of law applies to a consumer only to the extent that it does not restrict any mandatory statutory provisions of the state in which he has his domicile or habitual residence.

Cancellation information

Right to withdraw

You have the right to withdraw from this contract within fourteen days.

The revokation deadline starts from the day, you or a third party that is not the parcel service/carrier has received the merchandise.

in writing, via email or a letter, sent by a mail or postal service, your decision to revoke this contract.

Consequences of the cancellation

 

If you withdraw from this Agreement, you will have all the payments you receive, including delivery charges (except for the additional costs of having chosen a different type of delivery than our standard low-cost delivery), we will have to repay immediately and no later than fourteen days from the date on which the notice of cancellation of this contract has been received by us.

 

 

Otherwise, the return for you is free of charge. For the repayment, we use the same means of payment that you used in the last transaction, unless otherwise agreed with you; In no case will you be charged for this repayment fees.

 

We may refuse to repay you until we have the goods back or until you have provided proof that you have returned the goods, whichever is the earlier.

 

You have to return the goods to us at the latest fourteen days after the date on which you inform us of the cancellation of this contract.

 

You bear the immediate costs of returning the goods.

 

You will be liable for a possible loss of value of the goods, if this loss of value does not originate from an examination of the nature, characteristics and functioning of the goods.

In this way, they enable the seller to allocate the products as quickly as possible. Customers are requested to send the goods back to the seller as a prepaid parcel and to keep the proof of delivery. The postage costs, unless they are to be borne by the buyer. Customers are requested to avoid damage or contamination of the goods. If possible, the goods should be returned to the seller in their original packaging with all accessories. If the original packaging is no longer in the purchaser’s possession, other suitable packaging should be used to provide adequate protection against transport damage and to avoid any claims for damages due to defective packaging.
